Terms of Use

This is a translation of our Allgemeine Geschäftsbedingungen (AGB). In case of any discrepancy, the German version prevails.

1. Scope

These terms of use (the “Terms”) govern the use of the obseed platform, consisting of the web application at app.obseed.me, the “obseed” iOS app, the interface for AI assistants and the website obseed.me (together the “Service”). The Service is provided by obseed GmbH, Rossbergstrasse 30, 8310 Kemptthal, Switzerland (CHE-190.134.951), reachable at info@obseed.me (“obseed”, “we”).

The Terms apply to everyone who opens an account with obseed or uses the Service (“you”). Deviating terms of users apply only if we have expressly agreed to them in writing. The terms of the Apple App Store also apply to downloading the iOS app.

2. Contract and account

The contract for the use of the Service is concluded when you open an account and accept these Terms. Only natural persons aged 16 or older may open an account. By registering, you confirm that you have reached this minimum age.

You must provide truthful information when registering and keep it up to date. Each account is personal and may not be passed on to others. Keep your login credentials secret and notify us without delay if you suspect that your account is being misused.

3. Service description and availability

obseed is a platform for health and training data. The Service combines data from sources you connect yourself, for example Apple Health, Garmin, Oura, WHOOP, Wahoo and Withings, and presents it in a single overview. This includes analyses of sleep, heart rate variability (HRV), resting heart rate, body composition, energy expenditure and training sessions, tags and journal entries, as well as computed insights. The exact scope depends on the plan you choose and on the description on obseed.me.

We continuously develop the Service and may change, add or discontinue features as far as this is reasonable for you. We aim for high availability but do not owe uninterrupted or error-free availability. Interruptions due to maintenance, security measures, outages at third-party providers or force majeure are reserved.

4. Paid services

The core features of obseed are available free of charge in the Free plan. In addition, we offer paid services, namely the Pro and Elite plans and activations of the Energy Spread analysis. The prices and services shown on obseed.me or in the checkout at the time of the order apply, in Swiss francs (CHF). Payments are processed by our payment provider Stripe.

Subscriptions (Pro, Elite): subscriptions are billed monthly in advance and renew for a further billing period unless cancelled beforehand. You can cancel your subscription at any time in your account settings. The paid features remain available until the end of the current billing period; your account then switches to the Free plan. When you upgrade, the new features are available immediately; when you downgrade, your current plan continues until the end of the billing period.

Energy Spread: Energy Spread activations are paid once. An activation requires valid data from a cardiopulmonary exercise test (spiroergometry). After receiving payment, we usually unlock the purchased service within two business days. “Lifetime” access applies for as long as we offer Energy Spread.

Amounts already paid are not refunded pro rata unless mandatory law provides otherwise. Mandatory statutory rights, in particular withdrawal rights of consumers resident in the EU, are reserved.

5. Your obligations

In particular, you agree

• to use the Service only for your own lawful purposes and only with your own data or data you are entitled to use;
• not to upload or enter content that infringes the rights of others or is unlawful;
• not to disrupt or overload the Service or circumvent security measures, and not to query it automatically except through the interfaces we provide for that purpose;
• not to copy or resell the Service or make it commercially available to third parties.

6. Your data and content

Your health and training data and the content you enter (for example tags, notes and comments) belong to you. You grant us the non-exclusive right, limited to the term of the contract, to store, process and analyse this data as far as necessary to provide the Service. We acquire no further rights.

How we process personal data is described in our privacy policy, which also lists our processors and your rights. You can export or delete your data at any time.

7. Third-party providers

To import data, you connect the Service with accounts at third-party providers such as Apple Health, Garmin, Oura, WHOOP, Wahoo or Withings. Those accounts are governed exclusively by the respective provider’s terms. We have no influence on the availability, scope and accuracy of the data they provide and give no warranty for it. You can disconnect a connection at any time.

You may also voluntarily connect your account to a third-party AI assistant via the Model Context Protocol (MCP), for example Claude (Anthropic) or ChatGPT (OpenAI). Once data has been transmitted to such an assistant, its provider processes it under its own terms and on its own responsibility. Suggestions from the assistant are only added to your account once you confirm them in obseed.

8. AI features

obseed offers features that use artificial intelligence (large language models) to generate text, summaries and answers, for example the obseed AI chat. Such results are created automatically. They may be incomplete, outdated or wrong, even when they sound convincing. We give no warranty for the accuracy, completeness or fitness for a particular purpose of AI results. Review results critically before relying on them. The providers we use for this are listed in the privacy policy.

9. No medical advice

obseed is not a medical device under therapeutic products law and does not replace a medical examination, diagnosis or treatment. The Service provides no medical advice. Values from wearables and other sources can be inaccurate. Do not make decisions about your health based on the Service alone, and consult a doctor if you have complaints or before changing your training, nutrition or medication.

10. Liability

We are liable without limitation for damage we cause intentionally or through gross negligence, and for personal injury. Otherwise, our liability is excluded as far as permitted by law, in particular for slight negligence, indirect and consequential damage, lost profit, loss of data, and damage resulting from the use of AI results, from third-party data or from interruptions of the Service. Liability for auxiliary persons is limited to the same extent. Mandatory statutory liability, in particular under the Swiss Product Liability Act, is reserved.

11. Termination and account deletion

You can end the contract at any time by deleting your account in the settings. Running subscriptions end as set out in section 4. When you delete your account, we remove your data within the periods stated in the privacy policy, unless we are subject to statutory retention obligations.

We may terminate the contract by email with 30 days’ notice. In the event of serious or repeated breaches of these Terms, we may suspend your account immediately or terminate the contract without notice.

12. Changes to these terms

We may amend these Terms, for example for new features or changed legal requirements. We will notify you of material changes by email or in the Service at least 30 days before they take effect. If you continue to use the Service after they take effect, the amended Terms are deemed accepted. If you do not agree with the changes, you can delete your account beforehand.

13. Governing law and jurisdiction

These Terms are governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is the registered office of obseed GmbH.

Mandatory places of jurisdiction for consumers are reserved. If your habitual residence is in the EU, you also keep the protection of the mandatory consumer protection provisions of your country of residence.

14. Severability

If any provision of these Terms is wholly or partly invalid, the validity of the remaining provisions is not affected. The invalid provision is replaced by a provision that comes as close as possible to its economic purpose.
